In Mediation, a mediator is present to facilitate discussion to help the opposing parties reach a mutually acceptable agreement. In mediation the parties maintain control of decision making. Arbitration is an adversarial proceeding in which the arbitrator decides the outcome of a dispute, much as a judge in court would do. Evidence is submitted, witness testimony taken and argument heard. The arbitrator then renders a decision which is usually binding by contract. |
